826NYC (“we,” “us,” “our,”) respects your privacy.  This Privacy Policy (“Privacy Policy”) is intended to describe how we collect, use, and share information that you submit to us and that we collect through our website, www.826nyc.org and 826NYC’s online store at www.superherosupplies.com (together, the “Website” or “Site”).  

This Privacy Policy applies to personal information we collect or receive through the Website.  This Privacy Policy does not apply to other 826 National chapter websites or to information collected or submitted to us through means other than our Website.  For example, if you become a volunteer with us, or if you engage us to rent our spaces, our processing and use of your information will be governed by our contractual agreement with you in connection with that relationship.

As described in this Privacy Policy, we may collect certain personal information from or about you in connection with your use of, or your submissions to, the Website.  You are not required to provide all personal information identified in this Privacy Policy; however, please be advised that if you do not provide the personal information requested, we may be unable to provide some or all of the products or services to you.

  • Personal Information.  “Personal information,” for purposes of this Privacy Policy, generally includes information that may be used to identify you.  The personal information we collect may include your name, address, email address, phone number, and other information you choose to submit to us.  If you make a purchase through our online store or make a donation, we may also collect your payment information, such as your debit/credit card number and shipping and billing address.

We may use browser cookies for different purposes, including cookies that are strictly necessary for functionality and cookies that are used for personalization, performance/analytics, and advertising.   • when you use or interact with our Site or make a purchase or donation;
  • when you communicate with us, including when you submit information through the Site, submit inquiries, or request information from us, including inquiries or requests regarding renting our space;

  • when you apply to be a volunteer with us and sign up for our volunteer orientation courses;
  • when you register for or participate in our events or programs;
  • when you engage with our online communities, blogs, and forums, including any information you may provide through your interaction with or participation in our social media pages and groups.  Please note that online forums may be publicly accessible and other users may view information you post in the forums.  We encourage you to exercise care in deciding what information and content you wish to disclose on the areas of the Site that are accessible to the general public.
  • when we collect data from third parties or publicly-available sources.  

We use the personal information we collect as described in this Privacy Policy, including for the following purposes:

  • to provide the products and services, fulfill your orders, and administer and process purchases and donations;
  • to process, administer, and respond to your requests to volunteer or participate in our programs;
  • to contact and communicate with you and to address and respond to inquiries or requests;

We may disclose personal information as described in this Privacy Policy, including to other 826 National chapters and affiliate organizations within the 826 National network (“Affiliates”).  Where we share personal information with our Affiliates, we will require our Affiliates to honor this Privacy Policy.  We may also disclose personal information to our contractors, service providers, vendors, and other third parties we use to support our organization and provide and administer our programs and services, including our payment processors, hosting providers, for technical and processing functions, technical support, analytics, and for marketing and advertising purposes.


Disclosures Under Special Circumstances

We may also disclose information in order to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.  We also may provide information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, to protect the rights, property, or safety of our organization or any person, to enforce our agreements, or as otherwise required by law.

Subject to applicable law, we may disclose information to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale or transfer of all or a portion of our assets. If any such transaction occurs, the purchaser will be entitled to use and disclose the personal information collected by us in the same manner that we are able to, and the purchaser will assume the rights and obligations regarding personal information as described in this Privacy Policy.
